ร้านค้ามีหน้าที่รับผิดชอบในการตรวจสอบว่าสินค้าที่จำหน่ายบนแอปพลิเคชัน และ/หรือเว็บไซต์ LINE MAN (“แอปพลิเคชัน LINE MAN”) ของบริษัท ไลน์แมน (ประเทศไทย) จำกัด ร่วมกับบริษัท วงใน มีเดีย จำกัด (“บริษัท”) ให้เป็นไปตามกฎหมายและกฎข้อบังคับที่เกี่ยวข้องทั้งหมด เพื่อผลประโยชน์ของทางร้านค้า กรุณาศึกษาข้อกำหนดและเงื่อนไขสินค้าควบคุมของฉบับนี้ให้ครบถ้วน และปฏิบัติตามอย่างเคร่งครัดก่อนลงขายอาหารหรือสินค้าผ่านแอปพลิเคชัน LINE MAN
คำที่ทำเป็นตัวหนาซึ่งไม่ได้มีการระบุคำจำกัดความไว้ในข้อกำหนดและเงื่อนไขสินค้าควบคุมนี้ ให้มีความหมายตามที่ระบุไว้ในข้อกำหนดหลักเกี่ยวกับการบริการ
บริษัทได้แบ่งประเภทสินค้าควบคุมออกเป็น 2 ประเภท กล่าวคือ สินค้าควบคุมพิเศษและสินค้าควบคุมทั่วไป ซึ่งแบ่งตามเข้มข้นของการควบคุมตามกฎหมายที่ใช้บังคับในปัจจุบัน โดยมีรายละเอียดดังต่อไปนี้
ห้ามมิให้ร้านค้าจำหน่ายสินค้าควบคุมพิเศษ ดังต่อไปนี้ ทุกกรณี
(1) เครื่องดื่มที่มีส่วนผสมของแอลกอฮอล์สารเสพติด และสิ่งผิดกฎหมายทุกชนิด (เว้นแต่ แอลกอฮอล์ 0% ขายได้)
(2) บุหรี่ ยาสูบ บุหรี่ไฟฟ้า หรือผลิตภัณฑ์ที่เกี่ยวข้องกับยาสูบ/บุหรี่ไฟฟ้า
(3) น้ำกระท่อม ใบกระท่อม และอาหารที่ทำจากใบกระท่อม
(4) ผลิตภัณฑ์จากสัตว์/สัตว์ป่า และสัตว์/สัตว์ป่า รวมถึงสิ่งมีชีวิตอื่น ๆ
(5) อุปกรณ์สำหรับใช้ในการพนัน ตู้สล็อต
(6) ยา ยกเว้นยาสามัญประจำบ้าน
(7) เครื่องมือทางการแพทย์บางชนิด ได้แก่
ก. ผลิตภัณฑ์ที่มีสมบัติหนืดสําหรับใช้ในกระบวนการผ่าตัดตา
ข. ผลิตภัณฑ์ฟอกสีฟัน
ค. ชุดตรวจที่เกี่ยวข้องกับเชื้อ HIV
ง. กรดไฮยาลูโรนิกชนิดฉีดเพื่อแก้ไขข้อบกพร่องของผิวหนัง
จ. ถุงบรรจุโลหิต
ฉ. เต้านมเทียมซิลิโคนใช้ฝังในร่างกาย
(8) อาวุธปืน วัตถุระเบิด และอาวุธ
(9) อุปกรณ์ประกอบการโจรกรรม เช่น อุปกรณ์สะเดาะกุญแจ
(10) ตั๋วลอตเตอรี่
(11) ชิ้นส่วนมนุษย์ หรือซากศพ
(12) สินค้าที่หมดอายุ หรือใกล้หมดอายุ
ก. ของสด เช่น นมพาสเจอร์ไรส์ ขนมปัง ต้องมีอายุคงเหลือนับจากวันหมดอายุไม่ต่ำกว่า 3 วัน
ข. ของแห้ง อาหารแห้ง ต้องมีอายุคงเหลือนับจากวันหมด อายุไม่ต่ำกว่า 1 เดือน
(13) สินค้าที่ไม่มีเลข อย. หรือสินค้าที่ติดฉลากปลอม
(14) ผลิตภัณฑ์หรือรูปภาพที่มีการโฆษณาเกินจริง
(15) สินค้าที่ละเมิดทรัพย์สินทางปัญญาหรือกฎหมายทรัพย์สินทางปัญญา รวมถึงแต่ไม่จำกัดเพียง สินค้าที่อาจละเมิดลิขสิทธิ์ สินค้าเลียนแบบ สินค้าปลอม เป็นต้น
(16) สินค้าที่มีเนื้อหาลามกอนาจาร
(17) สินค้าที่ใช้แล้ว และสินค้าที่ถูกลักขโมย รวมถึงสินค้าที่ถูกอายัดหรือเรียกคืน
(18) เงินสด ธนบัตร เช็ค บัตรเครดิต หุ้น หรือวัตถุที่มีตราของรัฐที่ใช้ชำระหนี้ได้ตามกฎหมาย
(19) สารสกัดจากพืชกัญชาหรือกัญชงที่มี THC เกิน 0.2% และมิได้รับอนุญาตหรือปลูกในประเทศ
(20) สินค้าที่มีที่มา และ/แหล่งที่มาซึ่งเข้าข่าย และ/หรือผิดกฎหมาย
(21) สินค้าอื่น ๆ ตามที่กฎหมายกำหนด
(22) สินค้ากลุ่มกัญชา อันได้แก่ พืชกัญชา และส่วนต่าง ๆ ของพืชกัญชา รวมถึง อาหารและเครื่องดื่มที่มีส่วนประกอบของกัญชา หรือใบกัญชาที่มีการแปรรูปแล้ว
ห้ามมิให้ร้านค้าจำหน่ายสินค้าควบคุมทั่วไป ดังต่อไปนี้ เว้นแต่จะได้รับความอนุญาต ใบจดแจ้ง และ/หรือ ใบประกาศ และ/หรือ ใบอนุญาต และ/หรือความยินยอมจากหน่วยงานราชการ และ/หรือบุคคลภายนอกอื่นใดที่เกี่ยวข้อง ทั้งนี้ ในกรณีที่สินค้าประเภทใดจะต้องได้รับอนุญาตโฆษณาเพื่อจำหน่าย และ/หรือโฆษณา และ/หรือทำกิจกรรมส่งเสริมทางการตลาดใด ๆ ร้านค้าจะต้องดำเนินการดังกล่าวด้วยค่าใช้จ่ายของตนเองแต่เพียงผู้เดียว ทั้งนี้ ร้านค้ามีหน้าที่ในการกำหนดรูปภาพ รวมถึงระบุรายละเอียดเลขที่ และ/หรือรายละเอียดอื่นใดที่เกี่ยวกับการอนุญาต หรือการได้รับความยินยอมดังกล่าว หรือตามที่กฎหมายกำหนด บนรายละเอียดของสินค้าทุกคราว
(1) ยาสามัญประจำบ้าน
(2) เครื่องมือแพทย์
(3) สินค้าอื่นใดที่กฎหมายกำหนดให้มีใบอนุญาตมาตรฐานอุตสาหกรรม
(4) อาหารสัตว์และ/หรือซากสัตว์
(5) เครื่องสำอาง
(6) วิตามินและอาหารเสริม
(7) อาหารทารกและอาหารเสริมสำหรับทารก
(8) สินค้าอื่นใดนอกเหนือจากรายการที่กล่าวมา ที่กฎหมายกำหนดให้มีใบอนุญาตในการขายและ/หรือโฆษณาเพื่อการขาย
หากร้านค้าฝ่าฝืนไม่ปฏิบัติตามข้อกำหนดและเงื่อนไขสินค้าควบคุมฉบับนี้ บริษัทมีสิทธิดำเนินการดังต่อไปนี้
(1) ลบสินค้าออกจากแอปพลิเคชัน LINE MAN
(2) ระงับและยกเลิกร้านค้าออกจากแอปพลิเคชัน LINE MAN
(3) ระงับและยกเลิกบัญชีของร้านค้า
(4) ปรับเงินเป็นจำนวน 2,000 บาท หรือตามมูลค่าความเสียหายที่เกิดขึ้นจริง ทั้งนี้ แล้วแต่จำนวนใดจะสูงกว่าในแต่ละครั้งที่มีการกระทำความผิด
(5) ดำเนินคดีทางกฎหมาย ทั้งนี้ ร้านค้าตกลงจะรับผิดชอบความผิดในทางแพ่งและทางอาญาทั้งหมดแต่เพียงผู้เดียว
3. บริษัทอาจแก้ไข เปลี่ยนแปลงข้อกำหนดและเงื่อนไขสินค้าควบคุมฉบับนี้ได้ตลอดเวลาโดยมิต้องแจ้งให้ร้านค้าทราบล่วงหน้า ซึ่งบริษัทอาจเผยแพร่บนเว็บไซต์นี้ และ/หรือผ่านช่องทางอื่นตามที่บริษัทกำหนด ทั้งนี้ ร้านค้ามีหน้าที่ตรวจสอบข้อกำหนดและเงื่อนไขสินค้าควบคุมดังกล่าวตลอดเวลา ในกรณีที่ร้านค้าใช้บริการของบริษัทภายหลังจากได้มีการแก้ไขเปลี่ยนแปลงข้อกำหนดและเงื่อนไขสินค้าควบคุมฉบับนี้แล้ว บริษัทจะถือว่าร้านค้ารับทราบและยอมรับข้อกำหนดและเงื่อนไขสินค้าควบคุมที่แก้ไขนั้นแล้ว

The Partner Company is responsible for inspecting that the products sold on the LINE MAN application and/or website (“LINE MAN Application”) of Line Man (Thailand) Company Limited cooperating with Wongnai Media Company Limited (“Company”) shall comply with all related laws and regulations for the benefits of the Partner Company. Please study the Terms and Conditions of the regulated products of this contract entirely, and comply with them strictly before selling on the LINE MAN application.
Capitalized terms used but not defined in this Terms and Conditions of Regulated Products shall have the meaning given to them in the Master Terms of Service.
The company has classified controlled products into 2 categories, namely specially controlled products and generally controlled products, which are divided according to the intensity of control in accordance with the law currently in force, as detailed below:
It is prohibited to sell the following special controlled products in all cases:
(1) Alcoholic beverages, narcotic substances and all kinds of illegal things (except 0% alcohol).
(2) Cigarettes, tobacco, e-cigarettes or tobacco/e-cigarette-related products.
(3) Mitragyna speciosa (“Kratom”) juice and food made from Kratom leaves and Kratom leaves.
(4) Animal/Wildlife Products and animals/wild animals including other living things.
(5) Equipment for use in gambling, slot machines.
(6) Drugs, except general household remedy.
(7) Some medical devices, include:
a) Viscous products for use in ophthalmic procedures.
b) Teeth whitening products.
c) HIV-Related Test Kits.
d) Injectable hyaluronic acid to correct skin imperfections.
e) Blood bag.
f) Silicone breast prostheses are used to implant in the body.
(8) Firearms, explosives, and weapons
(9) Anti-theft devices such as lock-picking equipment
(10) Lottery ticket
(11) Human parts or corpses
(12) Products that are expired or about to expire:
a) Fresh products such as pasteurized milk and bread must have a shelf life of at least 3 days from expiration.
b) Dried goods, Dried food must have a shelf life of at least 1 month from the expiration date.
(13) Products without FDA numbers or products with counterfeit labels.
(14) Products or images that are falsely advertised.
(15) Products that infringe intellectual property rights or intellectual property laws, including but not limited to products that may infringe copyright, imitation products, counterfeit products, etc.
(16) Goods with obscene content.
(17) Used and stolen goods, including seized or recalled goods.
(18) Cash, banknotes, checks, credit cards, stocks, or items bearing the state's seal that can be legally used for debt repayment.
(19) Extracts from cannabis or hemp plants that contain more than 0.2% of THC are not permitted or grown in the country.
(20) Originated Products and/or source and/or illegal.
(21) Other products as required by law.
(22) Cannabis products, including cannabis plants and parts thereof, and food and beverages containing cannabis or processed cannabis leaves.
Partner Company are prohibited from selling the following general controlled products unless authorized, licensed and/or consented by government agencies and/or other relevant third parties. However, any product must be permitted to advertise for sale and/or promote and/or carry out any marketing promotion activities. The Partner Company shall do so at its sole expense. The Partner Company must specify the details of the number and/or any other information relating to such authorization or always consent to describe the goods.
(1) General household remedy
(2) Medical equipment.
(3) Any other products required by law to have industrial standard licenses
(4) Animal feed and/or carcasses
(5) Cosmetics
(6) Vitamins and supplements
(7) Infant food and supplementary food for infants
(8) Any other goods required by law to be licensed to sell and/or advertise for sale.
If the Partner Company does not comply with the terms and conditions of this controlled product, the company has the right to do the following:
(1) Delete the product from the LINE MAN application.
(2) Suspending and terminating the Partner Company from the LINE MAN application.
(3) Suspending and terminating the Partner Company's account.
(4) Fine in the amount of 2,000 baht or the value of the actual damage, whichever is higher each time an offense is committed.
(5) Take legal action. The Partner Company agrees to be solely responsible for all civil and criminal offenses.
